1. Acceptance of Terms
By accessing or using the AlgoColony website, software, applications, and related services (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”) and all policies incorporated herein. If you do not agree with any part of these Terms, do not use the Service.
2. Nature of Service
2.1 Automation Tools Only
AlgoColony provides software tools that enable users to create, configure, and automate rule-based actions (“Bots”), which may include:
- Triggering alerts
- Sending emails or notifications
- Posting to supported third-party platforms
- Executing trading actions via integrated third-party exchanges
AlgoColony does not:
- Provide financial or investment advice
- Provide brokerage, portfolio management, or intermediary services
- Execute trades independently of user-defined rules
- Guarantee performance of any strategy
- Hold or control user funds
2.2 No Custody of Funds
All trading and financial operations occur exclusively through third-party exchanges using API keys provided by the user. AlgoColony does not handle deposits, withdrawals, transfers, or custody of cryptocurrency, fiat currency, or other financial assets.
3. User Accounts & Security
3.1 Responsibility for Account Access
Users are solely responsible for:
- Maintaining the confidentiality of login credentials
- Managing API keys for connected exchanges
- Ensuring proper permissions and security settings
- All activity conducted under their account
3.2 API Keys
Users may connect exchange accounts through API keys with permissions they choose to grant. Users acknowledge that:
- API keys must be safeguarded
- AlgoColony cannot be held liable for misuse of API keys
- Users are responsible for understanding exchange API permissions
AlgoColony strongly recommends disabling withdrawal permissions on all API keys.
4. No Financial Advice
All content, tools, features, signals, data, backtests, simulations, and bot configurations provided by the Service are for general informational, educational, and technical purposes only.
Nothing on the Service constitutes:
- Financial advice
- Investment advice
- Trading recommendations
- Portfolio strategy
- Tax or legal advice
Users should consult with licensed professionals before making investment decisions.
5. Risk & Trading Disclaimer
- Trading cryptocurrencies, digital assets, forex, or other leveraged products involves substantial risk, including potential loss of your entire investment.
- AlgoColony provides automation tools and does not guarantee any profit or performance.
- All trading decisions and actions executed via your connected exchange accounts are entirely your responsibility.
- You should only trade funds you can afford to lose and consult licensed professionals if you need financial advice.
- Past performance, backtests, or simulations do not indicate future results.
6. API & Security Policy
- Users connect their exchange accounts through API keys they generate. Permissions are controlled by the user.
- Withdrawal permissions must never be provided to AlgoColony.
- API keys are stored encrypted and used only to execute user-authorized actions.
- AlgoColony implements reasonable security measures, including HTTPS and access control, to protect your API keys and account data.
- Users are responsible for securely storing their credentials and following exchange security best practices.
- AlgoColony is not liable for losses caused by compromised API keys, insecure passwords, or misuse of third-party exchanges.
7. User Responsibility & Compliance
Users acknowledge that all trades, decisions, strategies, configurations, and outcomes are solely their own responsibility. Users are responsible for:
- Security and confidentiality of credentials and API keys
- Compliance with all applicable laws and exchange terms of service
- Ensuring that data, scripts, or configurations do not violate third-party intellectual property rights
8. Limitation of Liability
To the fullest extent permitted by law, AlgoColony, its owners, employees, officers, contractors, and affiliates shall not be liable for any:
- Direct damages
- Indirect damages
- Incidental damages
- Special damages
- Consequential damages
- Punitive damages
- Loss of profits
- Loss of data
- Loss of trading opportunity
- Business interruption
Even if advised of the possibility of such damages. Users use the Service “as is” and “as available”, with no warranties of any kind.
9. Indemnification
Users agree to indemnify, defend, and hold harmless AlgoColony and its affiliates from any claims, actions, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- User’s use of the Service
- Violations of these Terms
- Misuse of API keys
- Trading losses
- Violations of laws or exchange rules
- Third-party claims relating to user activity
10. Third-Party Services
The Service may integrate with third-party platforms (e.g., exchanges, email providers, social media). AlgoColony:
- Is not responsible for the functionality, downtime, reliability, or security of third-party services
- Does not control third-party pricing, fees, or system behavior
- Is not liable for errors or losses caused by third-party actions or failures
Users must comply with the terms and policies of all third-party platforms they connect to.
11. Acceptable Use
Users may not:
- Use the Service for unlawful activities
- Interfere with, disrupt, or misuse the platform
- Reverse engineer or exploit the Service
- Use the Service to provide financial advisory services without appropriate licensing
- Upload malicious code or attempt unauthorized access
Violations may result in immediate termination of access.
12. Service Modifications
AlgoColony reserves the right to:
- Modify, update, or discontinue any part of the Service at any time
- Change or limit features
- Apply technical or security updates
- Restrict access for maintenance or security reasons
Users accept that such changes may occur without prior notice.
13. Termination of Service
AlgoColony may suspend or terminate a user’s access at its discretion, including for violations of these Terms or suspicious activity. Termination does not relieve users of obligations accrued prior to termination. Indemnification, limitation of liability, and disclaimers survive termination.
14. Privacy
Use of the Service is subject to AlgoColony’s Privacy Policy, which details how user data is collected and processed. By using the Service, users consent to the data handling practices described there.
15. Governing Law & Disputes
These Terms shall be governed by the laws of South Africa.
